Tracy Morgan update: Wal-Mart and McNairs reach out of court settlement; Morgan able to walk with cane
On June 7, 2014, comedian Tracy Morgan and James McNair were travelling in a limo-bus after completing a performance in Delaware. When the limo-bus reached New Jersey, a Wal-Mart truck crashed on the vehicle on the New Jersey Turnpike. The crash instantly killed 62-year-old James McNair who was a mentor and friend of "30 Rock" star Tracy Morgan. Morgan suffered severe brain injuries and broken bones following the crash.
The McNair family has reached an out-of-court settlement with Wal-Mart, according to Reuters. The terms of the settlement and the amount are confidential but the McNairs' family attorney, Daryl Zaslow, said Wal-Mart did not admit liability in the settlement. Morgan and three others have sued the retail giant in the New Jersey federal court.
Truck driver Kevin Roper faces criminal charges and has pleaded not guilty to the charges of vehicular homicide and assault-by-auto. The Chicago Tribune reports that the criminal complaint alleges that Roper was driving the truck without having slept in more than 24 hours. The preliminary investigation revealed that Roper was driving at the speed of 65 mph which is above the speed limit of 55 mph. The speed limit was further reduced to 45 mph that night because of construction.
However, the good news is that Tracy Morgan is recovering as he was spotted using a cane while heading to a New York City hospital. While he still walked with effort, the comedian looked much better while being accompanied by his fiancée Megan Wollover and their daughter, Maven, reports The Daily Mail. Right now, Morgan is concentrating on his recovery before commencing his battle in court.
Zaslow said that the McNairs were pleased with the settlement, saying, "No amount of money can replace what they've lost, but what they've got will take care of them and allow them to move forward, and their father would be happy for that". Wal-Mart spokeswoman Brooke Buchanan made a statement to the press saying, "We will continue to work to conclude all of the remaining issues as a result of the accident and we're committed to doing what's right".
Tracy Morgan is undergoing extensive physical and speech therapy.
